What will happen to my SSI (supplemental security income) If i get married to someone under age?

Im trying to get married soon. Im currently on SSI due to a car accident a few years back. The person im going to marry is under age and has a 6 month old baby. She has no job and no other source of income. How will this effect my SSI and can i claim them as dependents? she is 16. but she has been recognized as an adult in the court systems

  1. I have provided a link to the rules that apply. I think it may provide the answer.
  2. SSI is awarded to an individual. If you are married, the resources of the spouse are also considered. If your spouse has no resources, then your SSI will not be decreased. If SSI is your only income, you do not file a tax return and have no tax dependents. But your family may qualify for other benefits such as food stamps, public health insurance coverage, and assistance with utility costs based on your family income.
  3. If you are married, we also include part of your spouse’s income and resources when deciding whether you qualify for SSI. If you are younger than age 18, we include part of your parents’ income and resources. The spouse would never be claimed as a dependent on the married filing joint income tax return. You get 1 exemption for each spouse for 2 exemption amounts on the MFJ 1040 federal income tax return. Your future spouse child would only be her qualifying child until you are legally married and then it could possibly be a qualifying child dependent on you and your future spouse MFJ income tax return for the exemption amount after you are legally married. For all of the rules go to www.irs.gov and use the search box for PUBLICATION 17 go to 3. Personal Exemptions and Dependents http://www.irs.gov/publications/p17/index.html
  4. you will need to contact your agency to determine the effect this will be on your payment since this is a needs based assistance, you don't need a wife and baby to support
